IPI concerned about Cambodian journalist

Your Excellency,

The International Press Institute (IPI) is extremely concerned about the case of Nguon Nonn, editor-in-chief of the Morning News, who faces a jail sentence of up to one year and a heavy fine after his newspaper published articles implicating Cambodia’s minister of the interior and other high-ranking officials in the failed coup d’état of 2 July 1994.

Nguon Nonn was arrested on 8 July 1994 and has been detained at Phnom Penh’s "PJ" prison since then. At a hearing after his arrest, the Phnom Penh Municipal Court charged Nguon Nonn under articles 28 and 29 of the 1992 Press Law, which prohibit a newspaper from "disseminating an article which by its nature incites other persons to do something detrimental to the country’s domestic or international security" and from "publishing incorrect, falsified or exaggerated information if it is published with the intent to cause alarm among the citizenry or to impair public order".

We are informed that at the end of a two-hour long trial on 16 July 1994, Judge Thrung Ol of the Phnom Penh Municipal Court decided to postpone the proceedings against Nguon Nonn so that the prosecution could obtain additional evidence. Nguon Nonn was sent back to "PJ" prison.

Nguon Nonn’s arrest comes at a time of increased government pressure against the Cambodian media. Although IPI welcomes Judge Thrung Ol’s decision to postpone the proceedings, we believe that defamatory statements in the media should be addressed through civil defamation suits rather than through criminal procedures. IPI, representing, editors and leading journalists from newspapers, magazines, broadcasting organisations and news agencies in over 80 countries, strongly urges that all criminal charges against Nguon Nonn are dropped and that he is released immediately and unconditionally.
